Frontage terms of use

Version 17 September 2026

These terms are an agreement between you and SMARTSOL LIMITED, an Ontario corporation ("we", "us"), about Frontage: the app at app.frontage.cloud, the phone assistant, the Frontage mailbox, the client pages you send, and this website. You accept them when you create an account, and again when you take a phone number or reserve a mailbox. We keep a record of each acceptance: the version, the date and time, and the address it came from. Paying for a plan is covered by the SMARTSOL terms of sale, and how we handle personal information by the Frontage privacy notice. Both are part of this agreement.

1. Who may use Frontage

Frontage is a tool for commercial real estate professionals. To use it you must be at least 18, hold a valid licence or registration to trade in real estate in a Canadian province or territory, or work under someone who does, and act within what that licence allows. You must give accurate details about yourself and your brokerage and keep them current: they go on the documents Frontage produces in your name.

2. Your account

An account is for one person. Keep your password and sign-in codes to yourself, use two-factor sign-in where you can, and tell us at once if you think someone else has used your account. Everything done from your account is treated as done by you until you tell us otherwise. A team shares records by design; each member needs their own account and their own licence to use it.

3. Your records, and the people in them

What you put in Frontage is yours: contacts, buildings, leases, deals, documents, notes, calls. We claim no ownership of it, and we use it only to run Frontage for you, as the privacy notice describes.

Much of it is information about other people: tenants, landlords, callers, contacts at companies. For that information you are the organisation that collected it, and we process it on your instructions. You are responsible for having the right to collect it, keep it, and contact those people, and for doing so in compliance with the Personal Information Protection and Electronic Documents Act, Quebec's Act respecting the protection of personal information in the private sector (Law 25), any other privacy law that applies to you, and Canada's Anti-Spam Legislation (CASL). Frontage records the consent basis you enter for each contact and computes whether it still holds, but the entry, and the judgment behind it, are yours.

If someone asks you to see, correct or delete their information, you handle the request; we help where our systems are involved. If we receive such a request about information in your account, we may refer it to you and tell the person we have done so.

4. Acceptable use

Using Frontage, its mailbox, its phone line, its client pages or any message it sends on your behalf, you will not:

  • send a commercial electronic message to anyone without the consent CASL requires, or after they have withdrawn it, or without the identification and unsubscribe mechanism it requires;
  • send bulk, unsolicited or automated messages, or use the mailbox or phone line for anything other than your own brokerage work with your own clients and prospects;
  • harass, threaten, deceive or defraud anyone, or misrepresent who you are or whom you act for;
  • send anything unlawful, defamatory, infringing, or that contains malware or links to it;
  • put information in Frontage that you have no right to hold, or use it for a purpose the person it concerns would not reasonably expect;
  • call, or cause the phone assistant to call, anyone on the National Do Not Call List, or a number you may not lawfully call;
  • use Frontage to compete with us, scrape it, probe or overload it, circumvent its limits or security, or resell or share access to it;
  • let anyone unlicensed use your account to trade in real estate.

We do not review what you send. If a complaint, a bounce pattern, a carrier or a court tells us your account is being used in one of these ways, we act as section 9 describes.

5. The Frontage mailbox

A Frontage mailbox is an address on a domain we own and operate. It is provided for your brokerage correspondence, and mail sent from it carries our reputation and every other broker's. So, in addition to section 4: you send only to people you have a right to contact, you keep the volume to what one brokerage practice sends by hand, you do not use it for newsletters, campaigns or lists, and you stop sending to anyone who asks. We may suspend or retire an address at once if it draws complaints, is listed by a blocking service, or is used in a way that puts the domain at risk. A retired address is not reissued to anyone else, but it stops receiving mail. When your account closes, the mailbox closes with it.

You keep your own copies of anything you need. The mailbox is a working tool, not an archive, and a mailbox or its contents may be unavailable during an outage at Microsoft, on whose service it runs.

6. The phone assistant

The phone line answers calls to a number we provide through Twilio, records them, transcribes them, and acts on what it heard: it tells you about the call, creates or updates records, and drafts things for you. It announces at the start of each call that the call is recorded and that it is an AI assistant. You must not turn that announcement off, publish the number in a way that misleads callers about who answers, or use the recordings and transcripts for anything but your own brokerage work. Recording law differs by province and by the caller's location; where a caller is outside Canada, or where the law where you practise requires more than the announcement, it is your responsibility to comply.

The assistant speaks only from the listings you publish to it and never quotes a number it was not given, but it can mishear, misunderstand or be wrong. Nothing it says is an offer, a representation, or advice. Check what it recorded before you act on it, and correct it. Calls are charged from a prepaid balance at the rates shown in the app before you buy a number; the number is ours, provided to you while you keep it, and goes back to the carrier when you release it or your account closes.

7. Client pages and messages sent from Frontage

Shortlists, comparisons, tour books, letters of intent and every other page or document Frontage makes for you carry your name, brokerage and licence, and are sent by you to the people you choose. You are the sender for the purposes of CASL and any other law, whether the message goes from your mailbox or from ours on your behalf. Keep what you send accurate, and do not send it to anyone you may not lawfully contact.

8. AI features

Frontage drafts, summarises, compares and answers questions using AI models. It proposes; you decide. Its output can be incomplete or wrong, and it is not legal, financial, tax, valuation or investment advice, and not a substitute for your own judgment or for advice from someone qualified to give it. Read anything before you send it or rely on it. Your records are used to answer you and are not used to train models. AI use is metered by plan, as shown in the app.

9. Suspension and ending

You can close your account at any time from the app, which deletes your records as the privacy notice describes. We may suspend part or all of your account immediately if we reasonably believe it is being used in breach of section 4, 5, 6 or 7, if a carrier, mail provider, court or regulator requires it, if your payment fails as the terms of sale describe, or to protect Frontage, other brokers, or the people your records are about. We tell you why, and what would restore access, unless the law or the circumstance prevents it. We may end your account for a serious or repeated breach, in which case no part of a period already paid is refunded. We may also end Frontage itself, with at least 90 days' notice and a way to export everything.

10. Fees

Plans, the phone line and top-ups are priced in the app in Canadian dollars, before tax. Billing, renewal, cancellation and refunds are governed by the SMARTSOL terms of sale.

11. What we provide, and what we do not promise

We work to keep Frontage available, backed up and accurate, and we say in the app when a feature depends on another company's service. Frontage is provided as it is and as available, to the extent the law allows without warranty of any kind, including that it will be uninterrupted, error-free, or fit for any particular purpose, and without warranty about the accuracy of anything it produces. Some laws do not allow certain warranties to be excluded; where they apply, ours are limited to the minimum those laws permit.

12. Liability

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive loss, nor for lost commissions, deals, profits, data or reputation, however caused. Our total liability for all claims arising from Frontage in any 12 months is limited to the greater of the fees you paid us for Frontage in those 12 months and CA$100. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

13. Your responsibility to us

You will indemnify and hold harmless SMARTSOL LIMITED and its directors, officers, employees and contractors from any third-party claim, demand, fine, penalty, loss or cost, including reasonable legal fees, that arises from your use of Frontage or your breach of these terms — including information you put in it, messages you send with it, and any breach of CASL or a privacy law attributable to you. We will tell you about such a claim promptly and let you take part in defending it.

14. Our content and your licence to us

Frontage, its software, design, templates and documentation are ours or our licensors', and you get a limited, non-exclusive, non-transferable right to use them for your brokerage practice while your account is open. You give us the licence we need to store, process, display and transmit your records to run Frontage for you, and nothing more. Feedback you give us about Frontage we may use without obligation.

15. Changes

We may change these terms. For a change that affects you, we tell account holders by email and in the app at least 30 days before it takes effect, with the new version's date. Continuing to use Frontage after that date is acceptance; if you do not accept, close your account before it. The version you accepted is in your account's export.

16. Law and disputes

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Tell us about a problem first: most are fixed by support. Any dispute that is not is decided by the courts of Ontario, which have exclusive jurisdiction, except that either side may seek an injunction anywhere to protect its rights. If any part of these terms is found unenforceable, the rest stays in force. These terms, the terms of sale and the privacy notice are the whole agreement between us about Frontage.
